1. Agreement
These Terms of Service ("Terms") govern your use of aipersonalized.video (the "Site"), operated by InnovativeLabs ("InnovativeLabs", "we", "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
2. Use of the site
You may use the Site for lawful business purposes. You agree not to misuse it, including by interfering with its operation, attempting unauthorized access, scraping it in bulk, or submitting false or misleading information.
3. Early access is an application
Submitting an early-access application does not guarantee acceptance, availability, pricing or any particular result. We review applications at our discretion and may decline any application.
4. Services under a separate agreement
Any services we provide are governed by a separate written client agreement. If that agreement conflicts with these Terms, the client agreement controls for those services. Descriptions and examples on the Site are general and illustrative, and are not a promise of specific outcomes, such as view rates, reply rates or meetings booked.
5. Your likeness, voice and content
If you become a client, you grant us a limited license to use the footage, photos, voice recordings, names, logos and other materials you provide, and any AI models created from them with your consent, solely to produce and deliver videos for you. You confirm that you have the rights and consents needed for everything you provide, including the likeness and voice of anyone who appears in it.
6. Acceptable use of videos
Videos may not be used to impersonate anyone, to mislead recipients about who is speaking, or to make false or deceptive claims. We may decline or stop producing any video that we believe breaks these rules or the law.
7. AI-generated content
Videos, scripts and research are produced with the help of AI tools and may contain errors. Clients are responsible for the claims made in their outreach and for reviewing content where their client agreement provides for review.
8. Client compliance responsibilities
Clients are responsible for their offers, claims and the lawful use of our services, including compliance with applicable laws such as the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA) for text messages, CASL, the GDPR, the UK PECR and other email, messaging, privacy and marketing laws, and for honoring opt-out requests related to their business.
9. Intellectual property
The Site and its content, including text, design, graphics, animations and code, are owned by InnovativeLabs or its licensors and are protected by intellectual property laws. You may not copy, modify or distribute them without our written permission, except as allowed by law.
10. No warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, InnovativeLabs will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100).
12. Indemnity
You agree to indemnify and hold harmless InnovativeLabs from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms or applicable law.
13. Third-party links
The Site may link to third-party websites, including b2bprospector.com and personalizedcold.email. Third-party sites are governed by their own terms and policies, and we're not responsible for their content or practices.
14. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
15. Changes to these terms
We may update these Terms from time to time. We'll post the new version on this page and change the "Last updated" date. Continued use of the Site after changes means you accept them.
